The Incident: Publishing company Free Press Media Press Inc. uploaded its ebooks that it deemed appropriate for the educational marketplace Lesson Planned. One day Free Press Media Press Inc.'s Chief Publishing Officer Andrew Bushard went to upload ebooks and he discovered he could no longer upload ebooks.

Andrew Bushard emailed Lesson Planned to rectify this situation. Lesson Planned did not specify the reason for this, stating "Suspended" in one email and "Application Revoked" and in another email. Lesson Planned did not explain the reason for the suspension and revocation.

Another incident occurred in September/October 2022. On September 30, 2022, Andrew Bushard logged into his account at Top Music Marketplace to upload his books. When he logged in he received the error message,"RESTRICTED We can't sign you in right now. Your account might not been approved or has been disabled. Contact your merchant."

Andrew emailed the Top Music Marketplace's webmaster. The webmaster emailed the following explanation, "I understand that you're requesting for your seller account to be reactivated. However, since most of your product listings are not music teaching resources, we have deactivated your account."
